Registered vs Preliminary Contract in Egypt: What Buyers Should Know

When you buy an apartment in Egypt, the paper you sign matters as much as the apartment. Buyers often hear three different terms and are not sure how they differ. This guide explains them in plain words.

The preliminary contract

The preliminary (initial) sale contract is the agreement between you and the seller. It describes the unit, the price, the payment terms and the delivery date. It is the paper most buyers sign first, and it is what a developer uses while a project is being built. On its own, it does not make you the registered owner.

Signature validation

Some contracts go through a validation of the parties’ signatures. This gives the contract more weight as evidence, but it is still not the same as registering the property in your name.

Registered title

Registration is done through the Real Estate Registry (Real Estate Publicity Department), which is part of the Ministry of Justice. A registered title is the strongest proof of ownership. It is what makes it easier to transfer the property, leave it to family, or use it with a bank.

Why it matters to you

If you plan to keep the apartment for a long time, or to resell it, ask how and when registration will happen for your unit. Timelines depend on the property and on how complete the paperwork is, and can take from several weeks to a few months.

Questions to ask the developer

  • Which contract will I sign now, and at which stage can I register the unit in my name?
  • Who prepares the registration file, and who pays which fees?
  • What documents do you need from me, as a foreign buyer?
  • Can I have all of this in the contract, in writing?
